Terms of Service
What Musuwo is, what you can expect from it, and what it expects from you.
Governing law, dispute resolution, limitation of liability and any exclusion of consumer rights have NOT been settled by a Zimbabwean lawyer. Those sections describe an intention, not a tested legal position.
1. Who runs Musuwo
Musuwo is operated from Mutare, Zimbabwe. The registered entity name and company number are not yet published here, and will be added before Musuwo leaves the closed pilot.
Musuwo is a marketplace. It lists businesses and the things they sell, and it helps customers find and reach them. In most cases the seller is an independent business, not Musuwo.
Calling itself a marketplace does not mean Musuwo has no responsibilities. Where the law places a duty on a platform, that duty applies regardless of what this page says.
2. Musuwo is in a closed pilot
This matters and is stated plainly rather than buried:
- Musuwo is early. Features change, and some are not finished.
- Coverage is Mutare only.
- Payments are collected through Paynow Zimbabwe. Paynow, not Musuwo,
receives card and mobile-wallet credentials.
- Musuwo charges merchants no commission at the time of this version.
- The rider delivery network is not operating. Where delivery happens, the
merchant arranges it, or the customer collects.
If any of that changes, this document changes with it and gets a new version.
3. Who can use it
You need to be old enough to enter a contract in Zimbabwe to hold an account. Musuwo is not designed for children and is not directed at them.
You are responsible for what happens under your account. Do not share your password. Tell us if you think somebody else has it.
4. Accounts
You can browse and build a basket without an account. You need one to place an order, apply as a merchant, or contact a business through Musuwo.
Give real details. An account created with somebody else's identity, or with details invented to avoid a suspension, can be removed.
5. Ordering
An order placed through Musuwo is an order with the merchant, not with Musuwo. Musuwo passes it on and helps it get to you.
Prices, stock and descriptions come from the merchant. Musuwo does not check every listing before it appears. If something is wrong, report it.
6. Payment
Musuwo is not a bank and is not a payment institution. Checkout redirects you to Paynow Zimbabwe, which presents the payment methods enabled for Musuwo. Musuwo never receives your card number, PIN or mobile-wallet password. An order is confirmed only after Paynow sends a signed result that Musuwo independently checks with Paynow.
7. Delivery
See the Delivery Policy. In short: Mutare only, delivery is usually arranged by the merchant, and delivery times are estimates rather than guarantees.
8. Refunds
See the Refund and Returns Policy. Your rights under Zimbabwean consumer law are not removed by anything on this page.
9. What you may not do
Do not use Musuwo to break the law, to sell what may not be sold (see Prohibited Products), to impersonate somebody, to scrape it wholesale, to interfere with its security, or to harass anybody through it.
10. Things you upload
You keep ownership of what you upload. You give Musuwo permission to store and display it as part of running the service. You must have the right to upload it. See the Community Guidelines.
11. Suspension
Musuwo can suspend or remove an account or a listing that breaks these terms or the law, or where there is a serious safety or fraud concern. Where it is reasonable to do so, we will say why and you can respond.
12. What Musuwo does not promise
Musuwo does not promise that a merchant will perform well, that a listing is accurate, or that the service will be uninterrupted. It is a young service and it will sometimes be down.
Musuwo does not guarantee any product sold through it.
13. Verified merchants
A verified badge means specific checks were completed. It is not a guarantee of any product or transaction. See the Merchant Terms for exactly what is checked.
14. Liability
Musuwo intends to limit its liability for things outside its control - a merchant's conduct, content somebody else uploaded, an interruption to the service, a third party it relies on.
Some liability cannot lawfully be excluded, and this document does not try to exclude it. The precise limits have not yet been settled by a Zimbabwean lawyer, and that is stated rather than hidden behind confident wording.
15. Disputes
Talk to us first: support@musuwo.online. Most problems are a misunderstanding and are fixed faster that way.
If that does not resolve it, the dispute goes to the appropriate legal process. Musuwo has not adopted an arbitration clause, because whether one is appropriate or valid here is a question for a Zimbabwean lawyer and not for a template.
16. Governing law
Musuwo operates in Zimbabwe and intends Zimbabwean law to apply. This has not yet been confirmed by a lawyer.
17. Changes
When these terms change materially, the version number changes and you will be asked to look at the new one. Old versions stay readable, and the record of which version you accepted is kept.
